Todd Suddleson and Justin Roy Successfully Defend Case Involving Statute of Limitations

In November 2007, Todd Suddleson and Justin Roy tried the Donald Halpain case in Falls County, Texas on behalf of CertainTeed and Kaiser Gypsum. Mr. Halpain claimed to have asbestosis as a result of working around a number of different types of products throughout his career. In response to a Motion for Summary Judgment on the statute of limitations, the court ordered a trial on the limitations issue. The case was tried to a jury over two days and the jury returned a verdict in favor of defendants finding that the plaintiff knew that he had interstitial fibrosis and should have known that it was related to asbestos exposure more than two years before he filed his lawsuit.
